October 2, 2009 12 Noon Practical application of Takings, Exactions and Constitutional procedural requirements in Local Land Use Decisions
This Seminar will discuss the limitations on and common legal challenges to local land use decisions and will discuss practical steps local land use agencies should consider to conform to federal constitutional and statutory limitations. Among the topics discussed are: Procedural requirements for legislative and fact-finding hearings; administrative procedures that may be implemented to reduce the risk of litigation, legitimate factors in land use controls; use of moratoria; implementation of impact fees, dedications or other exactions; and related topics from recent court decisions or events.

October 9, 2009 12 Noon Fundamentals of Redevelopment Agreements - (uses and applications, terms, processes, risk allocation and mitigation, maintaining control, assuring performance, and other practical applications).
This Seminar will discuss the uses of and limitations on development incentive agreements applicable to various redevelopment mechanisms (tax increment financing, special taxing districts, tax abatement etc.) and practical aspects of redevelopment project financing and implementation. Participants will learn how to draft and use development agreements to: meet redevelopment objectives, assure timely developer performance, provide for temporary and permanent project financing, and avoid or reduce risks.
